DIGITAL PRODUCTS POLICY

This Digital Products Policy applies to the purchase and use of digital products and downloadable content offered by Silvertung, LLC ("Silvertung," "we," "us," or "our") through silvertung.com or any authorized Silvertung online store.

 

Digital products may include, but are not limited to, digital music, recordings, videos, artwork, graphics, photographs, documents, PDFs, files, downloads, digital merchandise, and other electronically delivered content.

By purchasing or downloading a Silvertung digital product, you agree to the terms below.

1. DIGITAL PRODUCT PURCHASES

Digital products are electronically delivered products and are not physical merchandise.

 

Before completing your purchase, please review the product description carefully to understand what is included with your purchase.

 

Unless otherwise stated in the product description, digital products are intended for personal, non-commercial use.

2. DELIVERY OF DIGITAL PRODUCTS

After a successful purchase, digital products may be delivered through one or more of the following methods:

  • Download link sent to the email address associated with the purchase

  • Access through a customer account

  • Electronic delivery through an authorized third-party service

 

Please make sure the email address provided during checkout is accurate and that you have access to it.

You are responsible for downloading and retaining your purchased digital products.

3. DOWNLOAD LIMITATIONS

4. DIGITAL PRODUCT REFUNDS

Because digital products can generally be accessed or downloaded immediately after purchase, all digital product sales are generally final and non-refundable once the product has been downloaded or access has been provided, except where required by applicable law.

If you experience a technical problem preventing you from accessing or downloading a digital product you purchased, please contact us before requesting a refund.

We will make reasonable efforts to resolve legitimate technical problems, including by providing a replacement download or another reasonable solution.

Nothing in this policy limits any rights you may have under applicable consumer protection laws.

5. INCORRECT EMAIL ADDRESS OR LOST DOWNLOAD

Silvertung is not responsible for delivery problems caused by an incorrect or inaccessible email address provided by the customer.

If you accidentally provide an incorrect email address or lose access to your download, contact us at silvertungband@gmail.com.

​

After verifying the purchase, we may be able to provide another download link or otherwise restore access.

6. LICENSE TO USE DIGITAL PRODUCTS

Purchasing a digital product from Silvertung, LLC gives you a limited, non-exclusive, non-transferable license to use the product for your personal, non-commercial purposes, unless the product description specifically states otherwise.

Purchasing a digital product does not transfer ownership of the underlying copyright, trademark, intellectual property, or other rights in the content.

 

7. PROHIBITED USE

Unless Silvertung, LLC has expressly authorized the use in writing, you may not:

  • Resell a digital product

  • Give away, redistribute, or publicly distribute the original digital file

  • Upload purchased files to file-sharing services

  • Make the files available for public download

  • Share download links intended for individual purchasers

  • Use Silvertung's digital products to create competing products for sale

  • Remove copyright, trademark, ownership, or other proprietary notices

  • Claim Silvertung's content as your own

  • Use Silvertung's content in a manner that infringes the rights of Silvertung or another party

  • Use purchased content for commercial purposes when the product is designated for personal use only

 

Additional restrictions may apply to individual products and will be disclosed in the applicable product description or license.

8. MUSIC AND AUDIO FILES

If Silvertung offers downloadable music or audio recordings, the purchase provides a personal license to listen to and enjoy the purchased recording.

 

Unless expressly authorized, purchasing an audio recording does not grant permission to:

  • Reproduce the recording for distribution

  • Resell the recording

  • Upload the recording to file-sharing or streaming services

  • Use the recording in commercial productions

  • Synchronize the recording with video or other media

  • Publicly distribute or broadcast the recording

9. DIGITAL ARTWORK, PHOTOGRAPHS, GRAPHICS, AND OTHER CREATIVE CONTENT

Digital artwork, photographs, graphics, logos, designs, and similar content remain the intellectual property of their respective owners unless expressly stated otherwise.

 

Purchasing or downloading such content does not transfer copyright ownership.

 

Unless expressly permitted, you may not reproduce, modify, sell, license, distribute, or commercially exploit the content.

10. DIGITAL PRODUCTS AND INTELLECTUAL PROPERTY

All digital products and content offered by Silvertung are protected by applicable copyright, trademark, and other intellectual-property laws.

​

Silvertung and related names, logos, artwork, recordings, photographs, designs, and other original content may be protected intellectual property belonging to Silvertung or its licensors.

​

Nothing in a digital product purchase grants you ownership of Silvertung's intellectual property unless expressly stated in writing.

 

11. PERSONAL USE VS. COMMERCIAL USE

Unless specifically stated otherwise, digital products purchased through silvertung.com are licensed for personal, non-commercial use.

 

If you would like to use Silvertung digital content for:

  • Commercial video

  • Advertising

  • Film or television

  • Podcasts

  • Business marketing

  • Public performances

  • Commercial recordings

  • Merchandise

  • Broadcasts

  • Other commercial purposes

Written permission may be required before such use.

 

12. PRODUCT COMPATIBILITY

Before purchasing a digital product, customers are responsible for reviewing any stated technical requirements, supported file formats, compatible devices, software requirements, or other product specifications.

 

Silvertung does not guarantee compatibility with every device, operating system, software application, or third-party service.

 

If technical requirements are provided on the product page, those requirements are considered part of the product description.

 

13. THIRD-PARTY DELIVERY SERVICES

Silvertung may use third-party platforms or service providers to process payments, deliver digital files, manage downloads, or provide access to digital products.

 

Those services may have their own terms and privacy policies.

 

Silvertung is not responsible for technical failures caused solely by a third-party service, although we will make reasonable efforts to assist customers in resolving legitimate delivery or access problems.

 

14. FRAUD, ABUSE, AND UNAUTHORIZED DISTRIBUTION

Silvertung reserves the right to investigate purchases that appear fraudulent or involve unauthorized distribution, excessive downloads, abuse of download systems, chargebacks, payment fraud, or other misuse.

 

Where reasonably necessary, Silvertung may suspend or terminate access to digital products associated with fraudulent or abusive activity.

 

Nothing in this section limits a customer's rights under applicable law.

 

15. CHARGEBACKS AND PAYMENT DISPUTES

If you experience a problem with a digital product purchase, please contact Silvertung before initiating a payment dispute whenever possible so that we have an opportunity to resolve the issue.

 

Fraudulent or unauthorized transactions may be investigated and reported to the applicable payment provider.

 

Nothing in this section limits any rights you may have under applicable law.

 

16. AVAILABILITY OF DIGITAL PRODUCTS

Silvertung may modify, update, discontinue, or remove digital products from sale at any time.

 

If you have already purchased a digital product, we will make reasonable efforts to maintain access to the product for the period stated at the time of purchase, where applicable.

 

Unless expressly guaranteed, Silvertung does not guarantee that a digital product will remain available for unlimited future access.

17. ERRORS AND CORRECTIONS

We make reasonable efforts to ensure that product descriptions, pricing, download information, and other Website information are accurate.

 

If an error occurs, Silvertung reserves the right to correct the error and, where appropriate, cancel or adjust an affected order.

 

If you have already paid for an affected order, we will provide any refund or other remedy required by applicable law.

 

18. CHANGES TO THIS POLICY

Silvertung may update this Digital Products Policy from time to time.

When changes are made, we will update the "Last Updated" date at the top of this policy.

The policy in effect at the time of your purchase will generally apply to that purchase, except where changes are required by applicable law.
